Temporary Graduate visa (subclass 485)

Subclass 485 is temporary visas for international students who have completed their Australian study and enable them gain suitable work experience in their field of study, and it generally comes with full working rights. It helps students to learn Australian work techniques and work environment which help them to use in their country of residence.

Eligibility Criteria

Location:

  1. Primary applicant must be in Australia but not in Immigration clearance
  2. If applying during concession period, then can be inside or outside of Australia if not applying for the second visa in post study stream as primary applicant or MOFU of primary applicant
  3. Family members of sc485 visa holder can be in or outside
  4. Combine application (item (item 1229(3)(h): Combine application is allowed if location of the secondary applicant is satisfied. Subsequent entrant application is also allowed for MOFU if primary applicant is already of the sc485 visa.

 

Nominate stream:
Applicant must nominate one steam i.e., either graduate or post study.

Nominate Occupation (item 1229(3)(l):
Primary applicant for graduate stream must nominate skilled occupation which is generally from the field of study and specified by minister in instrument LIN 19/051 with relevant list and assessing body for skill assessment.

Post study stream: first student visa granted on the basis of application made on or after 5th November 2011 i.e., current visa or any student visa held in past.

An applicant seeking to satisfy the primary criteria for the grant of a second Subclass 485
(Temporary Graduate) visa in the Post‑Study Work stream must hold a Subclass 485
(Temporary Graduate) visa in the Post‑Study Work stream

Visa/Immigration status of primary applicant:

  1. Either hold eligible student visa or
  2. If outside during concession period must have eligible student visa when made visa application outside or
  3. If holds BVA or BVB then must have held eligible student visa during period of 6 months immediately before the day of sc485 visa application or
  4. Must hold substantive visa and held eligible student visa at any time during the period of 6 months ending immediately before the day on which the application for the Skilled (Provisional) (Class VC) visa is made. Or
  5. The applicant must have been taken, under sections 368C, 368D and 379C of the Act, to have been notified that the Tribunal has set aside and substituted the Minister & 39;s decision not to revoke the cancellation of the applicant's eligible student visa not more
    than 28 days before the day on which the application is made. Or
  6. The applicant holds a Subclass 485 (Temporary Graduate) visa in the Post‑Study Work stream and is applying for a second Subclass 485 (Temporary Graduate) visa in the Post‑Study Work stream Or

 

Age of primary applicant:

Must be less than 50 at time of application.
Eligible student visa means a student visa, other than:
(a) a visa granted to a Foreign Affairs student or Defence Student; or
(b) a visa granted based on the applicant being a member of the family unit of the holder of a student visa.

Time of decision Requirement:
1. Never held sc476 or sc485 as primary applicant unless it is second application of post study and applicant has fulfilled all required conditions to get grant in post study stream

Evidence of English requirement:

Overall, 6 score with minimum 5 each in other module in IELTS test or equivalent score in others test such as OET, TOEFL iBT, PTE or CAE.
Exempt persons:  Valid passport holder and issued by one of the following countries:
 
a.       The United Kingdom.
b.       The United States of America.
c.       Canada.
d.      New Zealand; or
e.      The Republic of Ireland.

Police check
Age 16 or above applicants must have applied AFP in last 12 months before application and provide evidence of it.

Health Insurance:
Must hold OVHC at time of application and it should be continuing policy and intended to cover the visa period.

Post study Stream:

1. Qualification must be of AQF level 7 or higher:
(a)  Bachelor Degree;
(b)  Bachelor (Honours) Degree;
(c)  Masters by Coursework Degree.
(d)  Masters by Research Degree.
(e)  Masters (Extended) Degree and/or.
(f)   Doctoral Degree.
2. Must have completed above course from CRICOS register institution.
3. Must have completed Australian study requirement in the period 6 months immediately
before the day the application was made unless concession period applies

Second visa in post study stream: Regional center or other regional area

First visa must be granted based on study undertaken in regional center or other regional area. Primary applicant intended to live in regional area and secondary applicant intended to live, work and study in regional area as well. Primary applicant must have lived in those areas for at least 2 years before application of visa and if worked or studied then must be in those specified regional center of other regional areas. Above requirement must be met at the time of decision as well.

Designated Regional area
Similar requirements as those are mentioned above but must be in designated regional area instead of regional center or other regional area.

Visa validity:

  1. 2 years for second visa in post study stream. 2years starts from the grant of second visa and end of the first visa.
  2. If the applicant is granted a second Subclass 485 visa in the Post-Study Work stream (Regional extension) on the basis of meeting the requirements in clause 485.233, the holder is permitted to travel to, enter and remain in Australia until the later of the end of one year from the date of grant of the second visa; and the end of one year from the date the first such visa granted to the applicant would
    have otherwise ceased to be in effect.

 

Hong Kong passport holders – first Subclass 485 visa

Visas granted to Hong passport holders are to have effect for 5 years, irrespective of the stream they have been granted.

Note: The in-effect period for Subclass 485 visas held by a Hong Kong passport holder on 9 July 2020 is extended to 8 July 2025. The same extension applied to family members who satisfied the secondary criteria, regardless of the passport they held.

Graduate Work stream (primary applicants)
Visas granted to Graduate Work stream primary applicants are to have effect for 18 months from the date of grant or the date of first entry if the applicant is outside Australia.

Post-Study Work stream (primary applicants) – first Subclass 485 visa Visas

Granted to Post-Study Work stream primary applicants are to have effect (for the number of years from the date of grant or the date of first entry if the applicant is outside Australia) as follows, in a manner linked to their qualification:

  1. Bachelor’s Degree: 2-year visa period.
  2. Bachelor’s Degree with Honours: 2-year visa period.
  3. Master’s Degree by Coursework: 2-year visa period.
  4. Master’s Degree (extended): 2-year visa period.
  5. Master’s Degree by Research: 3-year visa period.
  6. Doctorate Degree: 4-year visa period.
